Hi all

We are applying for a building permit at the moment - we own a plot of 2.1 stremma on the westcoast, we obtained a forrest permission last year - if everything turns out right we hope to start building this fall...

However - some say that a change of law (in regard to how many stremma is needed to obtain a building permit) is just around the corner?! For a plot like ours - the change could be that we would need 4 stremma instead of 2 if we want the building permit... Has anybody more knowledge about the subject?

Hi,

The only rumour I have heard is that plots adjacent to villages (ie where now you might need 2000 to build) may be brought inside the town planning zone thus either increasing the amount that can be built or reducing the amount of land needed to build - I wouldn't like to say which!

As I said, that is just speculative hearsay and I may not even have understood properly.  Planning is very tricky to second guess.  I would advise you to check with an engineer or estate agent.

I've allready contacted my lawyer, a real estate agent and my engineer - no one can say for sure - one say restrictions (if they come) only apply to land zone, the other say it might also affect plots close to town planning zone...

Hi

I would have thought that whatever happens, if you have a building permit already you should be alright.  If no one knows what the new regulations may involve then it seems they may be a while off yet and not affect you at all. 

If I do hear anything definite then I will let you know.

If I remember correctly, the law may have already changed in this respect - much depends upon where your land is. If it is situated within "town planning" you may be OK; however, if it is outside "town planning" then I think you now need 4 stremma.

Hi Martyn,

I was under the impression that there are two areas of town planning.  One relating to land within the town (village) boundary and the other relating to land adjacent to it.  This adjacent land I thought you could build on within reason providing it was a certain area in size (2000sqm?) but subject to local variants as to exactly what was permitted. The  4000 sqm rule applied to land outside these boundaries subject to obtaining certain permissions of course..

Do you think that now any land outside the central area of a village requires 4000?

We hit a similar problem which might be the same one as you have heard of . Our architect contacted a local party ( think it was the council ) and within a few days we had a written response from them .

From memory the rules applied to new plots created ( registered) after 1 January 2004   ( unsure of actual date ) that out of town planning they  must have 30 metres frontage to  road  access and be 4 stremma.

Our plot was registered before the regulations took effect and so we were ok .
